Terms of Service
The short version: Bubble Surge is a free game you may play for personal fun. Do not break it, copy it, or misuse it. It is provided as is, ads support it, and your local app store's rules also apply.
1. Agreement
These Terms of Service ("Terms") are a legal agreement between you and KIBU Global Ventures LLC ("we," "us," "our") governing your use of the Bubble Surge mobile game and any related services (together, "the app"). By downloading, installing, or playing the app, you agree to these Terms. If you do not agree, do not use the app.
2. License to Use
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the app on devices you own or control, for your own personal, non-commercial entertainment. This license is subject to these Terms and to the rules of the app store you downloaded from.
3. Things You Agree Not to Do
- Copy, modify, translate, or create derivative works of the app
- Reverse engineer, decompile, or disassemble the app, except to the limited extent the law expressly permits
- Remove, hide, or alter any notices, branding, or advertising in the app
- Use cheats, automation, bots, or modified clients, or otherwise tamper with scores, ads, or game behavior
- Use the app to violate any law, or to infringe the rights of others
- Redistribute, sell, rent, or sublicense the app or any part of it
4. Ads
Bubble Surge is free and supported by advertising served through Google AdMob. By using the app you agree that ads will be shown, including full-screen ads between games and optional ads you choose to watch in exchange for in-game benefits such as an extra life or a daily boost. How advertising data is handled is described in our Privacy Policy.
5. Optional Purchases
The app is free to play. If we offer any optional in-app purchase in the future, it will be clearly described at the point of sale and processed by the Apple App Store or Google Play under their terms. Any one-time purchase such as removing ads is non-consumable and tied to your store account; you can restore it on a new device through the store. Refunds are handled by the app store according to its policies, not by us directly.
6. Intellectual Property
The app, including its code, artwork, the "Bubble Surge" name, the KIBU Global Ventures name and logo, sounds, and design, is owned by KIBU Global Ventures LLC and protected by intellectual property laws. Nothing in these Terms transfers any ownership to you. All rights not expressly granted are reserved.
7. Game Data
Your scores, streak, and settings are stored locally on your device. We do not back them up. Uninstalling the app, clearing its data, or switching devices will erase this data, and we cannot recover it for you.
8. Updates and Availability
We may update, change, suspend, or discontinue the app or any of its features at any time, with or without notice. We do not guarantee the app will always be available, uninterrupted, or error free.
9. Disclaimer of Warranties
The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error free, secure, or uninterrupted, or that defects will be corrected. You use the app at your own risk, to the fullest extent permitted by law.
10. Limitation of Liability
To the fullest extent permitted by law, KIBU Global Ventures LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of or inability to use the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us for the app in the twelve months before the claim (which for a free app is zero) or five U.S. dollars.
11. Indemnification
You agree to indemnify and hold harmless KIBU Global Ventures LLC from any claims, damages, or expenses arising out of your misuse of the app or your violation of these Terms.
12. App Store Terms
Your use of the app is also subject to the rules of the store you downloaded it from. For the Apple App Store, you acknowledge that these Terms are between you and us, not Apple, that Apple has no obligation to provide support for the app, and that Apple is a third-party beneficiary of these Terms entitled to enforce them. For Google Play, the Google Play Terms of Service also apply.
13. Governing Law
These Terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict of laws rules, except where the mandatory consumer-protection laws of your country of residence apply.
14. Changes to These Terms
We may update these Terms from time to time. The current version will always be posted at this URL with its effective date. Continuing to use the app after a change means you accept the updated Terms.
